Online Presentation: Rules of Evidence- Identifications
This is the media presentation used to introduce laypersons and law students to the legal rules of Identifications (under the rules of evidence). It discusses its value to the Crown, while also uncovering the shortcomings of this kind of eyewitness evidence, especially within the context of violent crimes. The 2 cases examined are R v. Henry, 2010 CarswellBC 2863, 2010, BCCA46, and R. v. Hinse [1995] 4 S.C.R. 597. The presentation also addresses the recommendations made by the various Canadian funded commissions, as well as steps certain police departments have taken in order to increase the accuracy of the identification process.
